सुशांत सिंग और अन्य केसेस से सबंधीत मामले मे हाई कोर्ट ने Nilesh Navalakha v. Union of India, 2021 SCC OnLine Bom 56 मे सीबीआय, केन्द्र सरकार, मुंबई पुलीस और अन्य सभी जांच एजेंसीयो को स्पष्ट निर्देश दिया था की वे एक विशेष अधिकारी की नियुक्ती करे जो समय- समय पर मिडिया और जनता को केसे की जांच में की गई प्रगती (Development) की जानकारी देते रहे।
इसमे गोपनीय जानकारी जैसे किसी आरोपी को गिरफ्तार करने जा रहे हैं, ऐसी जानकारी को बताना नहीं चाहिए लेकिन बाकी जांच की सारी बातें मिडीया और जनता को बताना सीबीआय, पुलिस और अन्य जांच एजेंसीयो के बंधनकारक है।
भारतीय संविधान और कानूनी प्रावधानो के अनुसार हर सरकारी संस्थान की जिम्मेदारी है की वे अपने कामो मे पारदर्शीता रखे। देश के हर नागरिक की हर सरकारी कामकाज की जानकारी हासिल करने का हक है। Citizens are having right to know.
Supreme Court in case of Union of India v. Assn. for Democratic Reforms, (2002) 5 SCC 294, had ruled as under;
“ 31(…) The Court pertinently observed as under: (SCC p. 453, para 74)
“74. In a government of responsibility like ours, where all the agents of the public must be responsible for their conduct, there can be but few secrets. The people of this country have a right to know every public act, everything that is done in a public way, by their public functionaries. They are entitled to know the particulars of every public transaction in all its bearing.”
बॉम्बे हाईकोर्ट द्वारा सीबीआय, पुलीस और अन्य जांच एजंसियो को दिये गये निर्देश निचे दिये गये है।
In Nilesh Navalakha v. Union of India, 2021 SCC OnLine Bom 56, it is ruled as under;
“359. That apart, one of the suggestions of Mr. Datar seems to us to be worthful and hence, we observe that Mumbai Police as well as the other investigating agencies may consider the desirability of appointing an officer who could be the link between the investigator and the media houses for holding periodic briefings in sensitive cases or incidents that are likely to affect the public at large and to provide credible information to the extent such officer considers fit and proper to disclose and answer queries as received from the journalists/reporters but he must, at all times, take care to ensure that secret and confidential information/material collected during investigation, the disclosure whereof could affect administration of justice, is not divulged….”
