Complaint’s main reliance is upon Mobile tower location of the accused, testimony of eye – witnesses and false defence taken by Aditya Thackeray.
Complainant also sought prosecution of police officers of Malvani police station who tried to destroy evidence to save accused.
Other co- accused are Sooraj Pancholi, Dino Moriya, Rohan Rai, Kishori Pendnekar, Sachin Vaze, Uddhav Thackeray, Anil Deshmukh.
Police officers of Malvani Police Station sent dead body of Disha Saliyan for post mortem after three days with ulterior motive to destroy the biological evidences of rape.
Aditya Thackeray had taken a defence that on 8th June 2020 when Disha died, he was at hospital to see his grandfather Shri Patankar who had died on that day. Said defence is falsified from mobile tower location of Aditya Thackeray and also from the fact that the grandfather of Aditya (Shri. Pathankar) actually died on the 14th June 2020 and not on 8th June as alleged by Aditya Thackrey.
Supreme Court and Bombay High Court had laid down the specific law that taking false defence is additional evidence to prove complexity of the accused.
It is further ruled by the Supreme Court that such accused should not be granted bail by the Court and they should be arrested and their custodial interrogation is must.
Complainant also sought investigation in suspicious death of Steve Pinto, friend of Disha Saliyan, who had exposed various offences committed by the accused.
