Mumbai: Special Correspondent: Recently, during the Lok Sabha elections, Ravindra Waikar was elected as an MP from Mumbai representing Shiv Sena. His victory margin was only 48 votes.
In this regard various allegations were made by the opposite Thackeray group regarding the malpractices in the election. One such allegation was that Ravindra Waikar’s representatives were using mobile phones at the counting site, In this regards an FIR was registered at ‘Vanrai Police Station’.
Subsequently, ‘Mid-Day’ and ‘Dainik Saamana’ published false news, alleging that during the police investigation, it was found that on the day of the vote counting, an election commission employee Sh. Dinesh Gurav gave a official mobile phone to one Sh. Mangesh Kundilkar a relative of Ravindra Waikar. The said mobile was connected with the EVM machine. The said relative of Ravindra Waikar then received an OTP and hacked the EVM machine to increase Waikar’s votes.
This false news was widely circulated and published on social media by Congress and Sh. Rahul Gandhi on his twitter handle (now ‘X’ handle). However, a press note issued later by the police proved that the said news was false. Additionally, Election Officer & Dy. Collector Mrs. Vandana Suryavanshi held a press conference and explained as to how the said news is false and clarified that there is no connection between EVMs and mobile phones, and no OTP is required to start the EVM.
Following this, ‘Mid-Day’ immediately published a clarification and apologized. However, neither the daily ‘Saamana’ nor MP Rahul Gandhi and the members of the Thackeray group apologized.
On the contrary to cover up their fraud the Thackeray group, led by MLA Aditya Thackeray, held a press conference to twist the facts and attempt to mislead the public once again, while also making several allegations against the Election Officer and the Deputy District Magistrate and also intimidated the Election officer.
In response to this, a complaint has been filed with the Police Commissioner by the Forum For Protection of Constitutional Rights of Public Servants (FPCRPS) through Advocate Tanveer Nizam and Advocate Nilesh Ojha.
This complaint has also been filed independently with the Speaker of the Lok Sabha, the Vice President & Chairman of the Rajya Sabha, the President of India, the Home Minister, and others. The complaint demands the following actions:
1. Legal Action Under IPC: Action against the accused under IPC sections 192, 193, 469, 500, 501, 120(B), 34, and 107.
2. Contempt of Courts Act: Action under the Contempt of Courts Act, 1971, sections 2(c), (b), and 12, for creating prejudices and threatening witnesses and officials.
3. Revocation of Positions: Revocation of parliamentary and legislative positions of the accused MPs and MLAs, along with a lifetime ban upon them on contesting any elections.
4. Media Restrictions: No government advertisements to be given to ‘Mid-Day’ and ‘Saamana’ newspapers, and their registration should be canceled.
5. Deregistration of Parties: Deregistration of the Congress party and the Thackeray group’s Shiv Sena party and the revocation of their recognition due to their unlawful and unconstitutional actions.
The Forum For Protection of Constitutional Rights of Public Servants (FPCRPS) recently intervened in an illegal FIR against the officers of the RTO departments in Nagpur and Amravati and in another case of FIR against the Deputy District Officer of Dharashiv district, helping them to get justice. They have a good support from many government department officials.
The committee in its complaint petition had given the proofs of court orders to prove that Shri Rahul Gandhi is habitual in spreading false narrative. Complaint states that Rahul Gandhi had previously spread false news against Prime Minister Narendra Modi, where he had been dragged in Supreme Court and served with the contempt notice. In the said contempt of court case, Sh Rahul Gandhi submitted an apology before the Supreme Court. The Supreme Court had warned him to be more careful in future and to exercise caution before making any public statements. Despite submitting an apology affidavit to the Supreme Court, Rahul Gandhi has repeated the same mistake, leaving no room for further forgiveness.
Additionally, MLA Anil Parab has also told several lies to the public about their stand that they have submitted an amended copy of the constitution of Shivsena party to the election commission. However, their falsity is exposed by the Assembly Speaker Sh. Rahul Narvekar. In fact, said false statement was also repeated by them in their affidavit before the Supreme Court therefore many leaders, MLAs along with their president Sh. Uddhav Thackeray and others, have been prosecuted in an contempt petition before Supreme Court. Said contempt petition is pending in the Supreme Court. [I.A. Aditya Thackeray’s affidavit filed in a public interest litigation concerning the gang rape & murder of Disha Salian and murder of Sushant Singh Rajput was found to be false, leading to a contempt & perjury petition in the High Court. [I.A. No. 18784 of 2023 IN PIL (Crl. ) No. 17983 of 2023, Supreme Court and High Court Litigants Association Vs . CBI]
Moreover, Thackeray group MP Sanjay Raut’s refusal to abide by the law and the Constitution led to his reprimand by the High Court, and the officials who supported him were also reprimanded. [Kangana Ranaut v. Municipal Corporation of Greater Mumbai, 2020 SCC OnLine Bom 3132]
All the evidence supporting these allegations has been attached to the complaint, underscoring the seriousness of the claims and the need for decisive action.
