Ex-Chief Secretary Sitaram Kunte, Ex-Minister Aditya Thackrey, Author Minhaz Merchant are also served with the notice.
All
the noticee have spread false narratives and conspiracy theories that unvaccinated
people are threat to society. However, their version is falsified from the
judgement of Supreme Court and High Court.
The subject of the notice reads thus;
“Subject: Notice for compensation of ₹ 500 Crore for Defamation, Humiliation, spreading hatred and inciting violence against my client by spreading conspiracy theories and false narrative that the unvaccinated people are a threat to other citizens. And violation of Constitutional fundamental rights of my client by way of bringing unlawful mandates with ulterior motives and malafide intention.”
The notice sender have asked the noticee to do the following acts;
“22. That the hardship suffered by my client can never be compensated in terms of money.
However, in order to cover the damages partly, my client serves this notice upon you:
(i) Pay an interim damage of ₹ 500 crores by Demand Draft within 15 days from the date of receipt of this notice.
(ii) Forthwith withdraw the said book and publish an unconditional apology of full front page in all newspapers and also publish a video of atleast 2 minutes on all electronic and social media.
23. This notice is independent of and issued by reserving the rights of initiating appropriate prosecution under Criminal Law i.e. under sections 166, 167, 341, 420, 153-A, 109,342, 499, 500, 501, 505, 115, 120(B), 34 & 52 etc of the Indian Penal Code which you may please note.”
The important paras of the notice are as under;
“2. That the Hon’ble Gauhati High Court in the case of Madan Mili Vs. Union of India 2021 SCC OnLine Gau 1503, passed on dated 19.07.2021 have also given similar observations that there is no difference between vaccinated and unvaccinated people with regard to spread of infection.
3. That, due to the death causing side effects of the Covishield (AstraZeneca) vaccine, around 21 European countries have banned the said vaccine.
4. Government of India’s AEFI committee had conducted investigation and had come to the conclusion that Covishield and other COVID-19 vaccines are having death causing side effects.
7. That, the Hon’ble Bombay High Court in its two judgements in the case of (i) Feroze Mithiborwala Vs. State of Maharashtra 2022 SCC OnLine Bom 356, (ii) Feroze Mithiborwala Vs. State of Maharashtra 2022 SCC OnLine Bom 457, had declared all of your such mandates as unconstitutional and illegal. In the said case, you noticee No. 1 to 4 were party respondents.

9. That, the Hon’ble Supreme Court on 02.05.2022 in Jacob Pulliyel Vs. Union of India 2022 SCC OnLine SC 533 had rejected affidavits of many states authorities including the State of Maharashtra and declared all such mandates as illegal and unconstitutional.
11. That, the major role played by you noticee in bringing such mandates with an ulterior motive to defame, humiliate and harass the unvaccinated people and force, coerce, and compel them to get the said deadly vaccines anyhow by creating an atmoshphere of hatered and inciting violence against them is ex-facie clear from the book written by noticee no. 5 Shri. Mehnaz Merchant titled as, “Iqbal Singh Chahal, COVID warrior”.
The said book got ‘Forward’ by the notice No. 4 Shri Uddhav Thakrey, the then Chief Minister of Maharashtra. The book is also having the references of you noticee no. 5 Sh. Aditya Thackery.
15. But then also, you noticee no. 1 to 5 acted against the law and put such mandates deliberately to serve your ulterior purposes of pushing my client to the danger zone of putting his life in danger by taking vaccines under pressure and against their will. And also, their life was in danger and constant fear and danger due to atmosphere of hatred created by you noticees. Many times, there was like possibility of attack, physical violence against my client by some people who were misinformed and nursing grudge against unvaccinated people due to false narratives and conspiracy theories run by you noticee.”
