After expressing regret, it is assured to Shri Shaikh by Indian Express that, henceforth no news will be published without taking view of counsel or press secretary of Sh. Shaikh.
Notice was issued after Shaikh got the proofs of interconnection between CJI Chandrachud and Indian Express and it linked the missing link and reason behind publication of such one sided defamatory news against Shri Shaikh who filed a Writ Petition to prohibit Justice Chandrachud from taking oath as CJI.
Mumbai: – Indian Express had published a news regarding dismissal of writ petition filed for stopping Justice Chandrachud from taking oath as CJI.
In the said news the proofs given in the writ petition and view of advocate and press secretary of Mursalin Shaikh was not published and a one sided story depicting Shaikh as offender was published.
Thereafter Sh. Shaikh have filed an application before Supreme Court to recall of said order. But Indian Express have not published any news regarding this.
On 23.03.2023 CJI Chandrachud attended a private program of Indian Express and this proved the missing link behind such sponsored and motivated news.
Based on all such proofs a legal notice was issued to Indian Express. After receipt of notice the said news was forthwith deleted and in reply notice dated 29.05.2023 it was replied on behalf of Indian Express that:
(a) The said news article is forthwith deleted i.e. within one day after receiving notice.
(b) They expressed regret for any inconvenience caused to Shri Shaikh.
(c) Assured Shri Shaikh that any future news will be published only after taking view from counsel or Press Secretary of Sh. Shaikh.
Since amount of compensation is not given and apology is not published in all the newspaper as demanded in the legal notice, therefore Sh. Shaikh had issued a second defamation notice on 02.06.2023.
It is informed that, very soon a case will be filed against Indian Express.
