Bombay High Court to Hear Petition Seeking Prosecution of Aditya Thackeray, Sr. Adv. Sudeep Pasbola, PI Shailendra Nagarkar, and APP S.V. Gawand on August 7

An FIR has already been registered by the CBI against Police Inspector Shailendra Nagarkar and former Mumbai Police Commissioner Param Bir Singh, pursuant to the directions issued by the Sessions Court at Kalyan, for their role in creating false and fabricated evidence with the intent to falsely implicate ACP Bhimrao Ghadge, a member of the Scheduled Caste community. ACP Ghadge is a key witness to serious criminal offences and conspiracies allegedly committed by Param Bir Singh and Shailendra Nagarkar, and the false implication appears to have been a calculated move to silence and discredit him in retaliation.
Further, on July 16, 2025, a Division Bench of the Bombay High Court led by Justice Ravindra Ghuge took judicial cognizance of a serious fraud on the Court committed by PI Prafulla Wagh of the Cyber Cell, Mumbai. It was noted that PI Wagh, through APP S.V. Gawand, had produced a fake person before the Court, in a clear attempt to mislead the judicial proceedings. The Court, in its order, observed that the conduct of the said police officer constitutes the offence of giving false evidence, punishable under Sections 227 and 229 of the Bharatiya Nyaya Sanhita, 2023 (corresponding to Sections 191 and 193 of the IPC).

The Bombay High Court has agreed to hear on August 7, 2025, a criminal writ petition along with three Interim Applications seeking the prosecution of Shiv Sena (UBT) leader Aditya Thackeray, Senior Advocate Sudeep Pasbola, Police Inspector Shailendra Nagarkar, and Assistant Public Prosecutor S.V. Gawand for their alleged involvement in a criminal conspiracy, suppression of evidence, and obstruction of justice in connection with the Disha Salian gang rape and murder case.
The hearing will also cover Interim Applications Nos. 8109, 2390, and 2393 filed by Shri Satish Salian, father of the deceased, and Intervention Application No. 2392 filed by accused Aditya Thackeray.
This hearing follows a string of serious judicial developments:
On July 2, 2025, the High Court expressed strong displeasure over the non-compliance of its earlier order dated 29.04.2025 and directed the Public Prosecutor to explain why the reply affidavit of the Chief Secretary had not been filed. The Court also questioned the APP for failing to respond to all applications and all the points raised by the Petitioner and pointedly recorded the submission that the APP would review the record, seek instructions, and file a detailed reply. —-The matter was mentioned on July 24, 2025, before the Division Bench by Adv. Vijay Kurle, appearing with Advocates Tanveer Nizam, Ishwarlal Agarwal, Abhishek Mishra, Anushka Sonawane, and others. The counsel pointed out that despite the Court’s earlier directive to list the case on July 16, it was inexplicably not placed on board.
Upon hearing the submission and perusing the precipe, Justice A.S. Gadkari instructed the Registry to ensure proper listing on August 7, 2025, and confirmed that all applications will be heard substantively on that date. —
The petition, filed by Shri Satish Salian, asserts that the death of celebrity talent manager Disha Salian in June 2020 was not a suicide, but the result of a brutal gang rape and murder, allegedly involving influential political figures and their associates.
The petitioner has sought the following key reliefs:
- Registration of an FIR against the named accused;
- Custodial interrogation of key suspects, including Aditya Thackeray;
- A court-monitored investigation to prevent destruction or tampering of critical evidence.
The petition also accuses certain police officers and legal professionals of misusing their official positions to facilitate a cover-up, mislead the judiciary, and shield the perpetrators from prosecution.
